PRIVACY POLICY

1.

This Privacy Policy sets out the rules for the processing of personal data obtained through the store online store www.shstore.eu (hereinafter referred to as "Online Store").

The owner of the Online Store and at the same time the data administrator is STREET HYPE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, registered in the register of entrepreneurs kept by the REGISTERED COURT for m.st. Warsaw, Poland, XIII ECONOMIC DEPARTMENT OF THE NATIONAL REGISTER OF JUSTICE under the KRS number 0000530675, with a share capital of PLN 40,000.00, NIP: 9512385373, REGON: 360073709, hereinafter referred to as SHSTORE.EU.

Personal data collected by SHSTORE.EU through the Online Store are processed in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation), also known as the RODO.

SHSTORE.EU takes special care to respect the privacy of customers visiting the Online Store.

§ 1 Type of data processed, purposes and legal basis

1.

SHSTORE.EU collects information on natural persons performing a legal action not directly related to their activities, natural persons conducting business or professional activities on their own behalf, and natural persons representing legal persons or organizational entities that are not legal persons, to which the law grants legal capacity, conducting business or professional activities on their own behalf, hereinafter collectively referred to as Clients.

2.

Customers' personal information is collected in the case of:

a)

register an account with the Online Store, in order to create an individual account and management of this account. Legal basis: necessity for the performance of the contract for the provision of the Account service (art. 6(6). 1 litre. b RODO);

b)

placing an order in the Online Store, in order to perform the sales contract. Legal basis : necessity for the performance of the sales contract (art. 6(6). 1 litre. b RODO);

c)

use of the contact form service in order to performance of the contract provided electronically. Legal basis: necessary for the performance of the contract for the provision of the contact form service (art. 6(6). 1 litre. b RODO).

3.

When registering an account with the Online Store, the Customer provides:

a)

email address;

b)

address details:

a.

zip code and city;

b.

street with house/apartment number.

c)

name;

d)

phone number.

4.

When registering an account with the Online Store, the Customer sets an individual password to access his/her account by himself/herself. The customer may change the password, at a later time, according to the rules described in §5.

5.

When placing an order on the Online Store, the customer provides the following data:

a)

email address;

b)

address details:

a.

zip code and city;

b.

street with house/apartment number.

c)

name;

d)

phone number.

6.

For Entrepreneurs, the above scope of data is further expanded to include:

a)

entrepreneur's company;

b)

tax ID number.

7.

When using the contact form service, the customer provides the following data:

a)

email address;

b)

name.

8.

When using the Store Website, additional information may be collected, in particular: the IP address assigned to the Customer's computer or the external IP address of the Internet provider, domain name, browser type, access time, type of operating system.

9.

Navigation data may also be collected from Customers, including information about the links and references they choose to click on or other actions they take on our Online Store. Legal basis - legitimate interest (art. 6(6). 1 litre. f RODO), consisting in facilitating the use of services provided electronically and improving the functionality of these services.

10.

For the purpose of establishing, investigating and enforcing claims, certain personal data provided by the Customer in the course of using the functionality on the Online Store may be processed, such as: name, surname, data on the use of services if the claims arise from the way the Customer uses the services, other data necessary to prove the existence of the claim, including the extent of the damage suffered. Legal basis - legitimate interest (art. 6(6). 1 litre. f RODO), consisting of the establishment, investigation and enforcement of claims, as well as the defense against claims in proceedings before courts and other state authorities.

11.

Transfer of personal data to SHSTORE.EU is voluntary, in connection with sales contracts concluded, or provision of services through the Store's Website, with the proviso, however, that failure to provide the data specified in the forms in the Registration process prevents the Registration and creation of a Customer Account, and in the case of placing an order without the Registration of a Customer Account, it will prevent the Client's order from being placed and processed.

§ 2 To whom the data are made available or entrusted and how long they are kept?

1.

Customer's personal information is transferred to service providers used by SHSTORE.EU in the operation of the Online Store. Service providers to whom personal data is transferred, depending on contractual arrangements and circumstances, either are subject to SHSTORE's instructions.EU as to the purposes and means of processing such data (processors) or themselves determine the purposes and means of processing (controllers).

a)

Processors . SHSTORE.The EU uses suppliers who process personal data only at the direction of SHSTORE.EU. These include m.in. providers providing hosting services, accounting services, providing systems for marketing, systems for analyzing traffic to the Online Store, systems for analyzing the effectiveness of marketing campaigns;

b)

Administrators . SHSTORE.EU uses suppliers who do not act solely on instructions and determine themselves the purposes and uses of customers' personal data. They provide electronic payment and banking services.

2.

Location . Service providers are mainly based in Poland and other countries in the European Economic Area (EEA).

3.

Customers' personal data are stored:

a)

If the basis for the processing of personal data is consent then the Customer's personal data is processed by SHSTORE.EU until consent is revoked, and after revocation for a period of time corresponding to the statute of limitations for claims that SHSTORE may assert.EU and what can be raised against it. Unless a special provision provides otherwise, the statute of limitations is ten years, and for claims for periodic benefits and claims related to the conduct of business - three years.

b)

If the basis for data processing is the performance of a contract, then the Customer's personal data is processed by SHSTORE.EU as long as it is necessary for the performance of the contract, and thereafter for a period corresponding to the period of limitation of claims. Unless a special provision provides otherwise, the statute of limitations is ten years, and for claims for periodic benefits and claims related to the conduct of business - three years.

4.

If you make a purchase from the Store, your personal data may be transferred to a courier company for the delivery of the ordered goods.

5.

Navigation data may be used to provide better service to customers, analyze statistical data and customize the Online Store to customers' preferences, as well as administer the Online Store.

6.

When a SHSTORE request is made.EU makes personal data available, to authorized state authorities, in particular organizational units of the Prosecutor's Office, the Police, the President of the Office of Personal Data Protection, the President of the Office of Competition and Consumer Protection or the President of the Office of Electronic Communications.

§ 3 Mechanism of cookies, IP address

1.

The online store uses small files, called cookies. They are saved by SHSTORE.EU on the final device of the person visiting the Online Store, if the Internet browser allows it. A cookie usually contains the name of the domain from which it originated, its "expiration time," and an individual random number that identifies the cookie. The information collected through these types of files helps customize the SHSTORE offered.EU products to the individual preferences and actual needs of visitors to the Online Store. They also give the opportunity to develop general statistics of visits to the presented products in the Online Store.

2.

SHSTORE.EU uses two types of cookies:

a)

Session cookies : when the session of a particular browser ends or the computer is turned off, the stored information is deleted from the device memory. The mechanism of session cookies does not allow the collection of any personal data or any confidential information from customers' computers.

b)

Persistent cookies : are stored in the memory of the Customer's terminal equipment and remain there until deleted or expired. The mechanism of permanent cookies does not allow any personal data or any confidential information to be collected from the Clients' computer.

3.

SHSTORE.EU uses proprietary cookies for:

a)

authentication of the Client in the Internet Shop and providing the Client's session in the Internet Shop (after logging in), thanks to which the Client does not have to re-enter his/her login and password on each sub-page of the Internet Shop;

b)

analysis and research, as well as audience auditing, and in particular to create anonymous statistics that help to understand how customers use the Store's Website, which allows to improve its structure and content.

4.

SHSTORE.EU uses external cookies for:

a)

popularization of the Online Store through the social network facebook.com (third-party cookie administrator: Facebook Inc based in the USA or Facebook Ireland based in Ireland);

b)

presentation of the Reliable Regulations Certificate through the reliableregulations website.pl (third-party cookie administrator: Reliable Group sp. featuring.o. based in Warsaw).

5.

The mechanism of cookies is safe for the computers of the Customers of the Internet Shop. In particular, by this route it is not possible for viruses or other unwanted software or malware to get into Customers' computers. However, in their browsers, customers have the option to limit or disable access of cookies to computers. If you use this option, the use of the Online Store will be possible, except for functions that by their nature require cookies.

SHSTORE.EU may collect customers' IP addresses. IP address is a number assigned to the computer of a person visiting the Online Store by the Internet Service Provider. IP number allows access to the Internet. In most cases, it is assigned to a computer dynamically, i.e. it changes every time you connect to the Internet, and for this reason it is commonly treated as non-personal identifying information. The IP address is used by SHSTORE.EU in diagnosing technical problems with the server, creating statistical analysis (e.g. determining from which regions we record the most visits), as information useful in administering and improving the Internet Shop, as well as for security purposes and possible identification of server overloading, unwanted automatic programs for viewing the contents of the Internet Shop.

8.

The online store contains links and references to other websites. SHSTORE.EU is not responsible for the privacy policies on them.

§ 4 Rights of data subjects

1.

Right to withdraw consent - legal basis: art. 7(7). 3 RODO.

a)

The customer has the right to revoke any consent he/she has given to SHSTORE.EU.

b)

Withdrawal of consent has effect from the moment of withdrawal of consent.

c)

Withdrawal of consent does not affect the processing performed by SHSTORE.EU in accordance with the law before its revocation.

d)

Withdrawal of consent does not entail any negative consequences for the Customer, however, it may prevent further use of the services or functionalities that SHSTORE legally provides.EU can provide only with the consent of.

2.

Right to object to data processing - legal basis: art. 21 RODO.

a)

The customer has the right to object at any time - on grounds related to his/her particular situation - to the processing of his/her personal data, including profiling, if SHSTORE.EU processes his/her data based on legitimate interests, such as marketing SHSTORE products and services.EU, to keep statistics on the use of particular functionalities of the Internet Store and to facilitate the use of the Internet Store, as well as to conduct satisfaction surveys.

b)

Resignation in the form of an e-mail from receiving marketing communications about products or services will imply the Customer's objection to the processing of his personal data, including profiling for these purposes.

c)

If the customer's objection proves to be valid and SHSTORE.EU will have no other legal basis for the processing of personal data, the Client's personal data will be deleted, against the processing of which, the Client has objected.

3.

Right to erasure of data ("right to be forgotten") - legal basis: art. 17 RODO.

a)

The customer has the right to request the deletion of all or some personal data.

b)

The customer has the right to request deletion of personal data if:

a.

personal data are no longer necessary for the purposes for which they were collected or for which they were processed;

b.

withdrew specific consent, to the extent that personal data was processed based on his or her consent;

c.

has objected to the use of his or her data for marketing purposes;

d.

personal data is processed illegally;

e.

personal data must be deleted in order to comply with a legal obligation under Union or Member State law, to which SHSTORE.EU is subject to;

f.

personal data was collected in connection with offering information society services.

c)

Despite the request for deletion of personal data, due to the filing of an objection or withdrawal of consent, SHSTORE.The EU may retain certain personal data to the extent that processing is necessary for the establishment, investigation or defense of claims, as well as to comply with a legal obligation requiring processing under Union law or the law of a Member State to which SHSTORE is subject.EU. This applies in particular to personal data including: name, surname, e-mail address, which data are retained for the purpose of processing complaints and claims related to the use of SHSTORE services.EU, or additionally the address of residence / mailing address, order number, which data is retained for the purpose of handling complaints and claims related to the concluded sales contracts or provision of services.

4.

The right to restrict data processing - legal basis: art. 18 RODO.

a)

The customer has the right to request restriction of processing of his personal data. The submission of a request, pending its processing, prevents the use of certain functionalities or services, the use of which will involve the processing of data covered by the request. SHSTORE.EU will also not send any messages, including marketing messages.

b)

The customer has the right to request a restriction on the use of personal data in the following cases:

a.

when he questions the accuracy of his personal data - then SHSTORE.The EU restricts their use for the time needed to verify the accuracy of the data, but for no longer than 7 days;

b.

when the processing of data is unlawful, and instead of deleting the data, the Customer requests a restriction on its use;

c.

when the personal data is no longer necessary for the purposes for which it was collected or used but is needed by the Customer to establish, assert or defend claims;

d.

when he/she has objected to the use of his/her data, in which case the restriction shall be for the time needed to consider whether, due to the particular situation, the protection of the Client's interests, rights and freedoms outweighs the interests pursued by the Administrator in processing the Client's personal data.

5.

Right of access to data - legal basis: art. 15 RODO.

a)

The Customer has the right to obtain confirmation from the Administrator as to whether it is processing personal data, and if this is the case, the Customer has the right:

a.

gain access to your personal information;

b.

obtain information about the purposes of processing, the categories of personal data processed, the recipients or categories of recipients of such data, the planned period of storage of the Customer's data or the criteria for determining this period (when it is not possible to determine the planned period of data processing), the Customer's rights under the RODO and the right to lodge a complaint with a supervisory authority, the source of such data, automated decision-making, including profiling, and the safeguards applied in connection with the transfer of such data outside the European Union;

c.

obtain a copy of your personal data.

6.

Right to rectify data - legal basis: art. 16 RODO.

a)

The customer has the right to request from the Administrator the immediate rectification of personal data concerning him/her that is incorrect. Taking into account the purposes of the processing, the Data Subject Customer has the right to request the completion of incomplete personal data, including by providing an additional statement, by directing the request to the email address in accordance with §6 of the Privacy Policy.

7.

Right to data portability - legal basis: art. 20 RODO.

a)

The customer has the right to receive his/her personal data, which he/she provided to the Administrator, and then send it to another personal data controller of his/her choice. The customer also has the right to request that the personal data be sent by the Administrator directly to such administrator, if technically possible. In such a case, the Administrator will send the Client's personal data in the form of a file in csv format, which is a commonly used, machine-readable format that allows sending the received data to another personal data controller.

8.

In the situation where the Customer exercises the right under the above rights, SHSTORE.EU meets the request or refuses to meet it immediately, but no later than one month after receiving it. However, if - due to the complex nature of the request or the number of requests - SHSTORE.EU will not be able to meet the request within one month, will meet it within the next two months informing the customer in advance within one month of receipt of the request - about the intended extension of the deadline and the reasons for it.

9.

The customer may submit complaints, inquiries and requests to the Administrator regarding the processing of his/her personal data and the exercise of his/her rights.

10.

The customer has the right to demand from SHSTORE.EU to provide a copy of the standard contractual clauses by directing an inquiry as indicated in §6 of the Privacy Policy.

11.

The customer has the right to lodge a complaint with the President of the Office for Personal Data Protection regarding the violation of his rights to personal data protection or other rights granted under the RODO.

§ 5 Security management - password

1.

SHSTORE.EU provides customers with a secure and encrypted connection when transferring personal data and when logging into the Customer Account on the Website. SHSTORE.EU uses SSL certificate issued by one of the world's leading companies for security and encryption of data transmitted over the Internet.

2.

If a Customer with an account in the Online Store has lost his/her access password in any way, the Online Store allows generating a new password. SHSTORE.EU does not send password reminder. The password is stored in encrypted form in such a way that it cannot be read. In order to generate a new password, it is necessary to provide an e-mail address in the form available under the link "You do not remember your password", provided at the form for logging into an account in the Online Store. The Customer will receive an email to the email address provided during registration or saved in the last account profile change, containing a redirect to a dedicated form provided on the Store's Website, where the Customer will have the opportunity to set a new password.

3.

SHSTORE.EU never sends any correspondence, including electronic correspondence, asking for login credentials, especially the password to access the customer's account.

§ 6 Changes to the Privacy Policy

1.

The Privacy Policy is subject to change, of which SHSTORE.EU will inform customers 7 days in advance.
